ALIMONY

Alimony in Florida is governed by Florida Statutes Chapter 61.08. Although there is no formula for computing alimony (as there is for child support), the legislature has identified several factors which the Court considers in awarding alimony. Among those factors are the length of the marriage, the age and physical condition of both the Husband and Wife, the financial resources, education and contribution to the marriage (such as taking care of children or supporting a spouse who attends college).  The Court may also consider the adultery of either spouse and the circumstances surrounding the adultery in considering an amount of alimony. This means that your spouse's adultery will act in your favor as will his or her dissipation of marital assets (ie sending money to a paramour) in determining the alimony award.
